How long should we wait for Justice?

The famous proverb i.e. "Justice delayed means justice denied", is proving itself that if, justice is not delivered in time it has no meaning for those given later on.

Petitioners, including author itself (Dr. Mukesh Yadav & Others v. Union of India & Others, W.P. (C) No.124 of 2008) filed a PIL in the Hon’ble Supreme Court in the hope that justice will be delivered instantaneously in the hands of Apex Court of India. First hearing was on April 15, 2008, where the Hon’ble Court ordered for the issue of notice to all the concerned Government Authorities. But till today after lapse of more than four months no date for second hearing is given. All Four pillars of democracy i.e. Legislature, Executive, Judiciary and Media, have been approached and all democratic ways of protesting, requesting, informing of grievances have been met with futile results.

The problem of unrecognized medical degrees / diplomas (M.D. / M.S.) awarded by the Government Medical Colleges in India in all most all the States are still prevailing. Advocates in spite of their best efforts are not able to tell the petitioners, when will be the next date of hearing? Most of the petitioners used and continuously using the Right to Information Act-2005, to know the gravity of situation, but insensitive government authorities including Medical Council of India, are not doing anything. All these prevailing situations are not enough for frustrating all the citizens of India? Are these not going against the democratic form of welfare state like India? If justice is not given at the door steps of Apex Court of India, where would a common man go?

Most of the unrecognized medical degrees / diplomas started in the early 1970s, and were supposed to be recognised by the Medical Council of India within three years of starting or directions for stop admissions should be given to concerned government authorities.

In one case M.D. (Forensic Medicine) was started in the year 1952, claimed to be pioneer in India at King George Medical College, Lucknow. It is claimed that CSMMU (erstwhile KGMU) is the first Resident Medical University of India. It is the best Medical Institution of U.P. ranking 4th best in India (grading by Hindustan Times). One of the text book of Forensic Medicine written by the author Late Dr. J.S. Modi, a postgraduate of KGMC, Lucknow, accepted as most reliable document in the Indian courts of law, but for the surprise of all of us his degree is till date not recognised by the MCI. Many medical degrees like M.D. (Radiodiagnosis), M.D. (Microbiology), etc. including M.D. (Forensic Medicine) are not recognised till date by the MCI. Is it not misrepresentation to the medical students and general public?

Custodian of maintenance of medical standards and uniformity in medical education in India under the mandate of the Indian Medical Council Act, 1956, itself being feeling frustrated by not able to stop admissions for violation of Minimum Standard requirement.  Everything is going wrong due to lack of political will and insensitivity of government authorities towards this issue of immense public importance. In spite of best effort of fourth pillar of democracy i.e. media by giving adequate coverage to this issue from time to time has been able to change the fixed insensitive attitude of the concerned government authorities.

One of the main reasons is adhocism approach of the government for not able to appoint even Director Medical Education at State level and Principals of many Government Medical Colleges. Many posts are not even sanctioned till date, after a gape of three to fourth decades of establishment of medical colleges in government sector. The last most important pillar of the democracy i.e. judiciary is approached in the hope that one day we all will get justice at the doorsteps of Apex Court of world’s largest democracy in this era of globalization.
